Mike Porter was arrested on the charges of murder and sexual assault after Kelsey's death. Thanks to the Briggs, he took a 30-year plea for enabling child abuse and will never have to register as a sex offender. He's in protective custody, thanks to Richard Smothermon, and is hidden away in another state presumably under a different identity. Raye Dawn was offered protection as well, but it meant too much to her to be near her family. She's in an Oklahoma prison serving a 27-year sentence for enabling child abuse with no protection. Since Mike Porter didn't go to trial, the jurors sentenced her for the crime Mike Porter committed and it wasn't even on the table. Why else give her 27 years for "should have known"?

This is a post from Jeanna Fowler trying to minimize the decision to allow Mike Porter to get away with never registering as a sex offender:

"The convictions of Michael Lee Porter and Raye Dawn Porter Smith will end the investigation into Kelsey's murder. The District Attorney in this case felt that the evidence of Kelsey's death leaned more toward Michael Porter than it did toward the mother. However, the timeline, the motive, the behaviors and the histories of the two individuals left room for reasonable doubt either way. (This is the Briggs family opinion, not the DA's.) Our family was in on the decision of whether or not to accept a plea deal for Michael Porter. It was an extremely difficult decision to make. Michael would not plead guilty to murder, manslaughter or child sexual abuse. We had to decide whether to take the chance of him walking free by acquittal because of reasonable doubt or sending him to prison for 30 years for enabling. It boiled down to words on paper. We had to decide how much the words "Murder" vs "Enabling Child Abuse by Injury" written on his plea agreement meant to us. It was a very difficult decison to make and we were given a short amount of time in which to make it. Ultimately, the decision rested upon Lance, Kelsey's daddy. He chose to send Michael Porter to prison for 30 years for his part in Kelsey's death, whatever that may be. Because neither the mother nor the stepfather will ever admit to what really happened to Kelsey on October 11, 2005, or the months leading up to her death, we will never know who abused Kelsey and who murdered her."

Mike currently has two women (that we know of) writing to him in prison. One of the women met him on Kathie's "bashboard" and the other met him prior to Kelsey's death but reunited with him on the "bashboard." Both women are married, but according to witnesses, both have ideas that they will have a relationship with Mike Porter once he's released from prison. One of the women is married with three children. The point I'm making is because of the fact that very little has been said about Mike Porter and Kathie never spoke against him, the public has the assumption (like I had when I first came to the case) that Mike Porter did not abuse Kelsey and she died as a result of an accident or that Raye Dawn did it. This is a DANGEROUS GAME because Mike Porter will be out of prison when he's still young enough to assault another child. Since he isn't required to register as a sex offender, he will be able to prey on another single mom. If Kathie was truly concerned with protecting children, in my opinion, she would have stopped at nothing to ensure that Mike Porter could never lay eyes on another child again! This is another reason it's so important that the public knows the truth about what happened to Kelsey. We need to make sure that Mike Porter doesn't have the opportunity to target another child.

In the confidential OCCY report, Mike Porter told DHS personnel - "Mike reports that Raye has a very close connection with Kelsey and that when they first started dating he was intimidated by the intensity of their relationship. He reports that Raye places a lot of her sense of self worth on her ability to be a mom and that he has seen Raye’s self esteem drop since she has not had Kelsey."

Could Mike's jealousy of Raye Dawn's relationship with her daughter be what drove him to abuse the child?

After Kelsey's death, Mike Porter acted strangely. He was heard at the hospital the day Kelsey died saying, "She'll never forgive me." He "passed out" at the hospital and had to be carried in on a stretcher. During the OSBI interview, he laid on the floor and said he was having chest pains. While Raye Dawn's sister and sister-in-law were at the house with Mike shortly after Kelsey's death he said he was going to shoot himself and the gun was put in a drawer. Mike went around the house searching for the gun and opened the drawer it was in and then closed it back and kept looking. He also said he'd taken an entire bottle of Tylenol and had them drive him around for hours and refused to go to the hospital. When Raye Dawn was cleaning out the house, she found an entire bottle of Tylenol had been thrown under the nightstand. The man who seemed to have it all together fell apart after Kelsey's death. Was it an effort to make himself look torn up over the loss of Kelsey? The night Kelsey died Raye Dawn and Mike stayed with Raye Dawn's sister and Mike ate a sandwich and looked around for chips and he slept through the night. Raye Dawn, however, couldn't eat and stayed up all night crying.

This is a statement from Mike Porter's daughter's school counselor. This was six days after Kelsey's death. Notice the fear Mike's Porter's daughter has of her father finding out what she said. From her descriptions, these events happened in their new home, which they moved into just a week or so before Kelsey's death. This was the same time that Mike told Raye Dawn "I hate you sometimes."

In my opinion, Mike enjoyed hurting Kelsey and watching Raye Dawn and every one of the agencies run around trying to find out what was wrong with her. Mike is a sick man! How could Kathie have been so friendly to him and rally to protect him but attack Raye Dawn?!

Mike's daughter even said that Mike was nice to Kelsey when others were around. Raye Dawn DID NOT KNOW Mike was hurting Kelsey. This is further proof of what a monster he is and how well he hid what he was doing from Raye Dawn. And his daughter had to witness it all. His bond terms said he was to have no contact with witnesses and his daughter was listed as a witness and in the emails you'll see that he had her for OVERNIGHT VISITS! How disturbing!!!

8:47am 10-17-2005 - ...MP's daughter had a little drink left so we went to my office so she could finish. I offered her a cookie which she took. MP's daughter said something about they thought her dad was the one who hurt Kelsey. This was the second time she had brought this up. I asked her if her dad had ever hurt her. She said no. I asked her if he had ever hurt her brother. She said no. I asked her if she had ever seen her dad hurt Kelsey. She hesitated then said yes. I asked her if she wanted to tell me about it. She said yes. She told me of the time she heard Kelsey getting a spanking. So she went upstairs and looked in the doorway to find her dad spanking Kelsey "real hard." She said he spanked her so hard it left her bottom "real red." She added, he spanked her until she threw up. MP's daughter also observed that when her dad went downstairs he did not tell anyone that he had spanked Kelsey or that she threw up. I told her it must have been hard to see that. She told me that when people were around her dad, he was nice to Kelsey. But, when no one was looking she said her dad was mean to Kelsey, I asked MP's daughter how she saw these things. She told me that her dad did not know she was watching. She told me Kelsey had lots of bruises when she was with her dad. I told her this must of been really hard to keep such a secret. I also said to her that this must be a lot for a little girl to bear. After a short pause, MP's daughter told me once she heard a loud thump outside. She went to the back door, and saw her dad hitting Kelsey's head on the brick wall. I asked her what she did next. She said she went outside and asked her dad what he was doing. He told his daughter that Kelsey was about to get sick. I told MP's daughter there are many people that thought it was Raye Dawn that was hurting Kelsey. She told me that the baby cried for Raye Dawn. MP's daughter said the baby crawled to Raye Dawn and clung to her leg and cried for her. I felt like MP's daughter was concerned about Raye Dawn. I told her that these days they have DNA testing and they can tell who did what. I asked MP's daughter if she felt better telling someone what happened. She asked me if her dad would find out. I told her she would be protected when that time came. I asked her if she was ready to go back to class. She said yes, and I walked her to class.
 

Mike Porter made a deal with the Briggs and the DA and is now serving a 30 year sentence for enabling child abuse. He will never have to register as a sex offender, which will allow him to prey on other children when he's released. Briggs supporters say he took responsibility for his crime. That's not true. He escaped his TRUE crime. They say that at least he's serving 30 years in prison and that he accepted his punishment. That's not true. He escaped a trial in which we would have learned the truth about Kelsey because apparently Kathie's desire to have Raye Dawn in jail was more important than making the man who murdered and sexually assaulted her grandchild pay.

Mike Porter was home alone with Kelsey when she was murdered and assaulted.

Kathie Briggs posted the following on her forum. She neglected to clarify that the computer was Mike Porter's and Raye Dawn didn't use it and didn't know what was on it or what he did with it. I'll clarify with her family, but I believe she thought he only used it for his business. By not clarifying that Raye Dawn had nothing to do with the computer, Kathie (as usual) has led her followers to believe that Raye Dawn had something to do with the filth on the computer. She didn't. While Mike and Raye Dawn lived in Mike's home in Shawnee the computer was kept in Kelsey's bedroom.

(Nobody suspected Mike Porter of anything until after Kelsey died. Agencies checked his background and all the testimony at the custody hearings told everyone involved that Mike Porter was a great father. There was never anything to the contrary brought to light during Mike's courtship and marriage to Raye Dawn. He was a true sociopath and hid the monster within from EVERYONE.)

I want to add one more thing...about the emails...I in NO WAY am friends with MP and I do not think he is an innocent man.  I truly feel he is the one who murdered Kelsey.  All of my contact with him was just to draw him out and to try to understand what kind of man he was.  I was not in cahoots with him to fry Raye.  I had to be nice to the low life to get him to think I believed him so he would continue to converse with me. .. MP makes my skin crawl.  He is a sorry, sorry human being and any contact I had with him was just to try and get some kind of understanding of what kind of life Kelsey had before she died. 

Shirica posted this on Kelsey's Purpose. I've NEVER seen them request prayers for Raye Dawn or the Smiths. But they've asked repeatedly for prayers for Mike Porter and his family.
